Sen. McCain is undoubtedly a citizen. He was born on Aug. 29, 1936, in the Panama Canal Zone, and Congress has specifically provided that anyone born there of U.S. parents, as he was, is a citizen. Indeed, the general rule is that anyone born of U.S. parents outside the United States is a citizen.

Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed “ADMITTED.” Therefore, Obama must immediately withdraw his candidacy for President.

At this point, him being "legally eligible" serves as a very small claim, or even a fact.
At this point, Obama or Cain, hearing them both talk, comparing their composure,
their words, their speeches, their counters; Its clear beyond a doubt that One is better suited for the position.
Such things like proving his ineligibility due to birthplace - are small compared to the amount of faith and belief that people have in him, which has not been seen in american history for decades.

IN AN OPEN LETTER to the American people, 62 Nobel Prize winners announced their support for the Democratic candidate for U.S. president, Sen. Barack Obama (http://www.barackobama.com/) (D-Ill.). Of the signers, 14 are Chemistry Nobel Laureates.
"We especially applaud his emphasis during the campaign on the power of science and technology to enhance our nation's competitiveness," the Sept. 25 letter (http://pubs.acs.org/cen/news/pdf/NobelLetter.pdf) said. The signers state that they support Obama's plans for new initiatives in education and training, expanding research funding, an unbiased process for obtaining science advice, and an appropriate balance of basic and applied research.
The letter was announced in a conference call led by three Nobel Prize winners: Harold E. Varmus, president of Memorial Sloan-Kettering Cancer Center; Peter C. Agre, director of the Malaria Research Institute at Johns Hopkins Bloomberg School of Public Health; and H. Robert Horvitz, a professor of biology at MIT. Varmus is chairman of the Obama science advisory committee.
The letter criticized the current Administration for engendering a science advisory process "distorted by political considerations."
"We wanted the public to be aware of the strong support Sen. Obama enjoys among the nation's leading scientists and of our conviction that he understands the connection between a vibrant research effort and the country's economic competitiveness," Varmus said.
In an interview with C&EN, Agre said the letter shows how scientists are coming together in terms of their views on the candidates. "Obama clearly has a much more friendly platform toward science and science education," he said.
Agre also disclosed that he has been an informal adviser to the Obama campaign, but, "for the record," he added, if Sen. John McCain (R-Ariz.) had "asked for my advice, I would have done it for him also."

I saw on the CNN/Obama channel this morning that the Feds will be backing Jumbo mortgate loans. You know what they are, don't you? Those are mortgages for people that are higher than $417,000. Apparently they are going to up it to nearly $800,000. We wouldn't want those banks that are Obama's top contributors to get stuck with that kind of mney would we? I mean those poor people with those million dollar homes don't want to lose their homes either! Not that you would find anyone like that living in a box under the tracks homeless if they have that kind of money. But hey, we wouldn't want JP Morgan, Lehman, Citigroup of Goldman Sachs to suffer any profit losses. I'm sure Barack thinks they deserve better. I'm just not sure how this helps out the poor people in America who are already losing their homes, but hey what do I know?

These companies you listed are part of the economical pie chart, whats amazing is that usually these big business corporations back Republican ideas, but now that they see they did not work, all this says is that the are willing to try something new before they lose more than they have been. It's not like campanges are free, they cost money, I think its nice to see corporations that once stood for different ideas of only self profit are now willing to vote for someone that is gonna tax them, not give them tax breaks or help them outsource to China. This says a lot, that even most of them want a change.
Why is it so hard for cats to stick to the issues that really matter, instead of just throwing unproven dirt on the other side, that don't mean you can run a country, all that means is you know how to blame someone else to save your own ass.
McCain is a war hero, no doubt. But even a great soldier doesn't mean they are gonna be great generals. People are already calling Obama a fraud with no substantial proof. Its dirty politics, not looking for solutions, but looking for loopholes to win.
This is not admirable, nor is it helping this country. The ones that can help this country are us, the ones that hold the power at election day, to vote for CHANGE. Instead of throwing dirt, read the proposals. And if you think our vote won't count, yes it will, and yes we can show the world we love this country and want to heal it.

Jumpstart the Economy
Enact a Windfall Profits Tax to Provide a $1,000 Emergency Energy Rebate to American Families:Barack Obama and Joe Biden will enact a windfall profits tax on excessive oil company profits to give American families an immediate $1,000 emergency energy rebate to help families pay rising bills. This relief would be a down payment on the Obama-Biden long-term plan to provide middle-class families with at least $1,000 per year in permanent tax relief.
Provide $50 billion to Jumpstart the Economy and Prevent 1 Million Americans from Losing Their Jobs: This relief would include a $25 billion State Growth Fund to prevent state and local cuts in health, education, housing, and heating assistance or counterproductive increases in property taxes, tolls or fees. The Obama-Biden relief plan will also include $25 billion in a Jobs and Growth Fund to prevent cutbacks in road and bridge maintenance and fund school re*pair - all to save more than 1 million jobs in danger of being cut.
Provide Middle Class Americans Tax Relief
Obama and Biden will cut income taxes by $1,000 for working families to offset the payroll tax they pay.
Provide a Tax Cut for Working Families: Obama and Biden will restore fairness to the tax code and provide 150 million workers the tax relief they need. Obama and Biden will create a new "Making Work Pay" tax credit of up to $500 per person, or $1,000 per working family. The "Making Work Pay" tax credit will completely eliminate income taxes for 10 million Americans.
Eliminate Income Taxes for Seniors Making Less than $50,000: Barack Obama will eliminate all income taxation of seniors making less than $50,000 per year. This proposal will eliminate income taxes for 7 million seniors and provide these seniors with an average savings of $1,400 each year. Simplify Tax Filings for Middle Class Americans: Obama and Biden will dramatically simplify tax filings so that millions of Americans will be able to do their taxes in less than five minutes. Obama and Biden will ensure that the IRS uses the information it already gets from banks and employers to give taxpayers the option of pre-filled tax forms to verify, sign and return. Experts estimate that the Obama-Biden proposal will save Americans up to 200 million total hours of work and aggravation and up to $2 billion in tax preparer fees.
Trade
Obama and Biden believe that trade with foreign nations should strengthen the American economy and create more American jobs. He will stand firm against agreements that undermine our economic security.
Fight for Fair Trade: Obama and Biden will fight for a trade policy that opens up foreign markets to support good American jobs. They will use trade agreements to spread good labor and environmental standards around the world and stand firm against agreements like the Central American Free Trade Agreement that fail to live up to those important benchmarks. Obama and Biden will also pressure the World Trade Organization to enforce trade agreements and stop countries from continuing unfair government subsidies to foreign exporters and nontariff barriers on U.S. exports.
Amend the North American Free Trade Agreement: Obama and Biden believe that NAFTA and its potential were oversold to the American people. They will work with the leaders of Canada and Mexico to fix NAFTA so that it works for American workers.

Reward Companies that Support American Workers: Barack Obama introduced the Patriot Employer Act of 2007 with Senators Richard Durbin (D-IL) and Sherrod Brown (D-OH) to reward companies that create good jobs with good benefits for American workers. Invest in the Manufacturing Sector and Create 5 Million New Green Jobs
Invest in our Next Generation Innovators and Job Creators: Obama and Biden will create an Advanced Manufacturing Fund to identify and invest in the most compelling advanced manufacturing strategies. The Fund will have a peer-review selection and award process based on the Michigan 21st Century Jobs Fund, a state-level initiative that has awarded over $125 million to Michigan businesses with the most innovative proposals to create new products and new jobs in the state.
Double Funding for the Manufacturing Extension Partnership: The Manufacturing Extension Partnership (MEP) works with manufacturers across the country to improve efficiency, implement new technology and strengthen company growth. This highly-successful program has engaged in more than 350,000 projects across the country and in 2006 alone, helped create and protect over 50,000 jobs. But despite this success, funding for MEP has been slashed by the Bush administration. Barack Obama and Joe Biden will double funding for the MEP so its training centers can continue to bolster the competitiveness of U.S. manufacturers.
Invest In A Clean Energy Economy And Create 5 Million New Green Jobs: Obama and Biden will invest $150 billion over 10 years to advance the next generation of biofuels and fuel infrastructure, accelerate the commercialization of plug-in hybrids, promote development of commercial scale renewable energy, invest in low emissions coal plants, and begin transition to a new digital electricity grid. The plan will also invest in America's highly-skilled manufacturing workforce and manufacturing centers to ensure that American workers have the skills and tools they need to pioneer the first wave of green technologies that will be in high demand throughout the world.
Create New Job Training Programs for Clean Technologies: The Obama-Biden plan will increase funding for federal workforce training programs and direct these programs to incorporate green technologies training, such as advanced manufacturing and weatherization training, into their efforts to help Americans find and retain stable, high-paying jobs. Obama and Biden will also create an energy-focused youth jobs program to invest in disconnected and disadvantaged youth.
Boost the Renewable Energy Sector and Create New Jobs: The Obama-Biden plan will create new federal policies, and expand existing ones, that have been proven to create new American jobs. Obama and Biden will create a federal Renewable Portfolio Standard (RPS) that will require 25 percent of American electricity be derived from renewable sources by 2025, which has the potential to create hundreds of thousands of new jobs on its own. A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.
Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.
Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.
He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.

Without a doubt, the Respondents will note that the premise behind Akins was the failure to obtain information, and will attempt to distinguish APCC because it involves standing in the context of contracts, assignors and assignees. However, Mr. Berg has indeed sought information vital to the election process put forth in the U.S. Constitution, and this Court in APCC stated that, apart from historical precedent for permitting suits by assignees under assignments for collection, “n any event, we find that the assignees before us satisfy the Article III standing requirements articulated in more recent decisions of this Court.” Furthermore, this Court’s treatment of the standing doctrine in APCC should be enough to show that the reasoning exhibited by the district court judge, grounded in Lujan, misperceives the three prongs of standing as enunciated just four months ago by this Court.
Therefore, because of the reasons stated above, because of the “sliding scale” nature of a “test” for injury in fact, because the very essence of civil liberty certainly consists in the right of every individual to claim the protection of the laws whenever he receives an injury, this Court should hold that the Petitioner has standing to prosecute this action and reverse the decision from the district court which maintains otherwise.
On a promissory estoppel claim which, in my opinion, is a tempting but populist stretch (errors in formatting/indenting are on my end):
Barack Obama and the DNC made promises to the Petitioner and to the American people, reasonably expecting—in fact, counting on the idea—that the promises would induce reliance, those promises induced the Petitioner to expend money and billable hours and the American public to donate more than $600 million to Obama’s campaign, and injustice can only be avoided by adjudication in this Court.
A cause of action under promissory estoppel arises when a party relies to his detriment on the intentional or negligent representations of another party, so that in order to prevent the relying party from being harmed, the inducing party is estopped from showing that the facts are not as the relying party understood them to be. [I]Thomas v. E.B. Jermyn Lodge No. 2, 693 A.2d 974, 977 (Pa.Super. 1997)(citing Rinehimer v. Luzerne County Community College, 539 A.2d 1298, 1306 (Pa.Super.), app. denied, 555 A.2d 116 (1988)). Promissory estoppel is applied to enforce a promise which is not supported by a binding contract. Carlson v. Arnot-Ogden Mem’l. Hosp., 918 F.2d 411, 416 (3d Cir. 1990) (holding promissory estoppel is unwarranted in light of court’s finding that parties formed an enforceable contract); Bosum Rho v.Vanguard OB/GYN Assocs., P.C., No.Civ.A.98-167, 1999 WL 228993, at *6 (E.D.Pa. Apr. 15, 1999).
With regard to the doctrine of promissory estoppel, it is manifested, and not actual, intent which is paramount. The question is not what Obama and the DNC actually intended, as Judge Surrick claimed in his Memorandum, but rather what the Petitioner and the American public, as promisees, were justified in understanding that intent to be. There is no sound reason to suffer the harms in question because the U.S. District Court, Eastern District of Pennsylvania incorrectly dismissed the Promissory Estoppel claim. Judge Surrick claimed the DNC’s promises were not actually promises but instead of statement of intentions. Judge Surrick went on further claiming “The ‘promises’ that Plaintiff identifies arc statements of principle and intent in the political realm. They are not enforceable promises under contract law. Indeed, our political system could not function if every political message articulated by a campaign could be characterized as a Legally binding contact enforceable by individual voters, Of course, voters are free to vote out of office those politicians seen to have breached campaign promises and Federal courts, however, are not and cannot be in the business of enforcing political rhetoric.”
The DNC and Obama made promises in writing which were posted on their website to lure people to donate money based on their promises. The DNC named this document “Renewing America’s Promise,” which presents the 2008 Democratic National Platform. In this document, the DNC promises among other things “use technology to make government more transparent, accountable and inclusive,” “maintain and restore our Constitution to its proper place in our government and return our Nation to the best traditions, including their commitment to government by law” and “work fully to protect and enforce the fundamental Constitutional right of every American vote — to ensure that the Constitution’s promise is fully realized”.
Obama placed on his website and stated on national television his promise to open and honest Government and his promise to truthfully answer any questions asked of him.
As a result of his detrimental reliance on these promises, Plaintiff donated money and billable hours to Democratic Presidential candidates as well as the Democratic National Committee.
The DNC did in fact break promises by promoting an illegal candidate to run for and serve, if elected, as President of the United States, clearly in violation of the United States Constitution and in violation of their promise to enforce the fundamental Constitutional rights of every American voter. Furthermore, Obama has not answered, in an honest manner, questions about his citizenship. Moreover, Obama has breached his promise to uphold our Constitution; Obama is a Constitutional lawyer and is well aware he is ineligible to serve as the United States President. This is hardly an example of being open and honest, this is hardly an example of open and honest government, and it is neither the way to uphold our United States Constitution, nor the Oath of Office taken by Obama.
According to Berg, a television crew from Fox News Channel will be present to follow him as he files the documents at the U.S. Supreme Court. As I’ve written over the past few days, however, the odds of the writ being granted and the case actually being heard by the U.S. Supreme Court are slimmer than slim. Still, Berg is optimistic.
"We are at a crucial time for the United States of America," Berg said. "I am hopeful that the Supreme Court will do what is necessary to avoid a certain constitutional crisis."

It is firmly established that Stanley Ann Dunham (Obama’s mother) married Lolo Soetoro Mangunharjo, a Muslim Indonesian citizen. Her new husband adopted Barack Hussein Obama II; his name was legally changed to Barry Soetoro. Obama spent years in Indonesia and attended two Indonesian schools. I have no answer to that one and the U.S. State Department certainly will not release any information unless ordered by a federal judge. Obama failed to disclose any of his other known names on his Illinois Bar Registration. He lied without blinking an eye.

Bucking, whats so hard to understand, Philip Berg is wrong.
First of all, how the hell can anyone even run for any office without being an American Citizen, this isn't his first time in politics. Do you know the qualifications there are to even be eligible for election as an Senator? If he was never a citizen, he never would of made it that far, hehehe, its just another last minute attempt to scare people in thinking he is more a Muslim terrorist than he is an American. Its a shameful tactic, and I can't believe your still blowing that silent alarm like if it really means something.
